Leasing of Immovable Property to Foreigners in Turkey
Foreign nationals who have obtained a residence permit have the right to rent a house. The Turkish Code of Obligations clearly regulates how to rent an immovable property. First of all, the lessor and the foreign citizen must enter into a lease agreement for the immovable property. This situation does not differ for foreign nationals and Turkish citizens, and the same conditions apply to both parties. The important point here is that a foreign citizen must have a residence permit in order to rent an immovable.
Sale of Real Estate by Foreigners
We have explained how foreigners can acquire property in Turkey. In cases where the sale of the immovable property is realized in accordance with the procedures we have explained, the foreigner can now establish a right of pledge on the immovable property in Turkey, rent out the relevant immovable property and sell it. However, a number of different documents are required during the sale process. These documents are
- Foreign ID or passport
- Compulsory earthquake insurance policy for buildings
- Valuation report on the immovable (Valuation report is valid for three months from the date of application)
- If the transaction will be realized through a representative, a power of attorney containing authorization to make the relevant transaction
- One passport size photograph
After the application is made to the Land Registry Directorate with the relevant documents, there is no restriction specific to foreigners in this regard, and Turkish Laws will apply to the relevant disputes.
